Automotive Accident - $12,300,000 Settlement
In this case, three plaintiffs were hit head-on in their lane of travel by a driver who had a long history of traffic violations. The driver's employer continued to keep him in their employment, despite his numerous traffic violations both before and after the subject accident. One of the plaintiffs had severe traumatic brain injury and the other plaintiffs had life-threatening injuries, but both eventually recovered.

Class Action Fraud - $8,000,000 Settlement
This case involved a statewide class of plaintiffs who were the victims of deceptive sales practices by a finance company and a satellite television operator. The class action settlement also involved injunctive relief to prevent these companies from engaging in similar actions in the future.

Automotive Product Liability - $4,500,000 Settlement
In this case, the plaintiff, an eight year-old little girl, was rendered paraplegic and also suffered a traumatic brain injury which was caused when she jack-knifed over a lap belt in her family's van.

Discovery in the case revealed that the automotive manufacturer was well aware of this type of injury, especially to children, when they refused to install three-point belts in the rear outboard seating positions of this van and other vehicles.

Automotive Product Liability - $4,000,000 Settlement
In this case, the plaintiff was a 4-year old child who was rendered a ventilator-dependent quadriplegic as a result of an injury sustained while wearing a lap belt only. During the prosecution this case, evidence was uncovered that the manufacturer specifically knew that small children received spinal cord injuries when belted with lap-only belts and that these injuries could be eliminated by use of a three-point lap/ shoulder belt in conjunction with a booster seat. The vehicle involved in this case was a 1989 model sedan, which was the same model year in which the manufacturer "promised" to put lap/shoulder belts in the rear seats of all of its vehicles.

Premises Liability - $4,000,000 Settlement
This case involved a minor plaintiff who received a devastating head injury when a retaining wall collapsed adjacent to the area where he and his father were fishing. Evidence uncovered during the case revealed that the property owner was well aware that there were problems with the stability of the retaining wall and that people regularly fished in the area adjacent to the wall.

Commercial Trucking Accident - $3,500,000 Settlement
This wrongful death case involved a trucking accident where the plaintiff was rear-ended by a tractor trailer rig that was owned by a commercial motor vehicle carrier. In that accident, the plaintiff was rear-ended when she was braking to avoid an accident that was occurring ahead of her on the interstate. Evidence uncovered during discovery revealed that the defendant's driver was previously terminated from a prior employer for testing positive for drugs and was hired by the defendant in violation of the Federal Motor Carrier Safety Regulations. Although blood and urine tests of the defendant's driver after the accident were negative for alcohol and drugs, the plaintiff was successful in procuring expert testimony that the drug test following the accident was invalid because the sample was diluted.

Automotive Product Liability - $3,000,000 Settlement
In this case, the plaintiff was injured in a single-vehicle accident when a defective sports utility vehicle rolled over on a flat road surface. Discovery in that case revealed that the manufacturer was well aware of the stability problems with the vehicle, yet nevertheless, marketed and sold the vehicle in the United States.

Automotive Product Liability - $2,750,000 settlement
This case involved a rollover of a pickup truck where the roof of the truck crushed down, causing the plaintiff’s spinal cord injury that resulted in his quadriplegia. The manufacturer contended that the plaintiff’s injuries were not caused by the crushing of the roof; rather, the manufacturer argued that the plaintiff’s injury occurred when he "dove" into the roof structure. Discovery in this case revealed that one of the defendant's wholly-owned subsidiaries conducted roll tests and drop tests of their vehicles, unlike this defendant. Further evidence revealed that the defendant’s wholly-owned subsidiaries also reinforced the roof structures of their vehicles in the same manner as plaintiff’s experts contended the defendant should have done in plaintiff's pickup truck.

Automotive Product Liability - $2,475,000 Settlement
A 52-year old nurse was killed in this single vehicle accident. This accident occurred after the plaintiff lost control of her vehicle because of a tire failure. She was then ejected because of a defective door latch which came open during the accident sequence as a result of minimal contact with the guardrail. Litigation testing revealed that this same door latch would come open with slight contact to the linkage rods.

Automobile Product Liability - $1,750,000 Settlement
This case involved an allegation of a defective door latch in a sport utility vehicle. In this case, the decedent was ejected from a sports utility vehicle, during a rollover, and was killed. Evidence was uncovered during discovery that showed that the manufacturer of the SUV was aware of prior problems with this door latch assembly system.

Automobile Accident - $1,500,000 Settlement
The defendant driver in this case was towing a trailer without safety chains or a pin. This accident occurred when the trailer became disengaged from the vehicle, crossed two lanes of traffic, and hit the plaintiff head-on in his lane of travel. The plaintiff died from injuries received in this accident.

Automobile Product Liability - $1,100,000 Settlement
This case involved a rollover accident where the roof on a sport utility vehicle crushed, causing the plaintiff's permanent injuries. The manufacturer contended that it was not liable for this injury, and supported its defense of the case with Federal Motor Vehicle Safety Standard 216. Evidence uncovered during discovery proved that automobile manufacturers are well aware that compliance with Federal Motor Vehicle Safety Standard 216 does not in any way correlate to real world protection of occupants.

Automobile Product Liability - $1,000,000 Settlement
The plaintiff in this automobile accident died when his seatback collapsed causing him to be ejected from the vehicle. During discovery in the case, the plaintiff was able to obtain evidence that the manufacturer was well aware of the defective nature of its seatbacks and refused to make a recommended design change that would have cost approximately $.75 per seat.

Automobile Product Liability - $950,000 Settlement
In this case, the plaintiff received severe neurological injuries as a result of a defective passive belt system. The seatbelt system was the subject matter of a mandatory safety recall. Although the plaintiff sustained severe injuries, fortunately she made a miraculous recovery and today suffers from minimal deficits.
